Decisive Dates Nearing in Ripple Lawsuit After “Biggest News” in Months

Ripple is making “good progress” in its legal battle with the U.S. Securities and Exchange Commission. In a major Victory, the SEC complied with the court’s order and produced its former employee William Hinman’s documents, although under seal. In 2018, Hinman declared Ethereum not to be security.

Ripple general counsel Stuart Alderoty stated excitedly: ‘’Over 18 months and 6 court orders later, we finally have the Hinman docs (internal SEC emails and drafts of his infamous 2018 speech). While they remain confidential for now (at the SEC’s insistence), I can say that it was well worth the fight to get them’’.

In the latest update shared by James K. Filan, the SEC has submitted for in-camera review by Magistrate Judge Netburn proposed redactions to two drafts of Hinman’s June 2018 speech that discuss pending determinations before the SEC.

SpendTheBits, a private company that developed an application that uses XRP Ledger and XRP for transferring Bitcoin, is the latest third party to request to file an amicus curiae brief in the ongoing lawsuit.

Oct. 24 remains a big “reveal” date as parties are expected to file publicly redacted versions of the opposition briefs. Crypto law founder, John Deaton shares what the public might likely see on Monday, Oct. 24, “The public will get to read limited redacted versions of the oppositions only. Unfortunately, the public will not be able to read the 56.1 statements, counter statements, exhibits, deposition testimony, etc., until late December or January.”

Other key dates include: On Nov. 15, the parties would file summary judgment reply briefs temporarily under seal. Then on Nov. 17, the parties would meet and confer to identify redactions sought by each side in the reply briefs.

Nov. 21 is another big date as the parties file publicly redacted versions of the reply briefs. On Dec. 9, the parties are expected to file an omnibus motion to seal all materials relating to the summary judgment motions.

Then on Dec. 22, the parties will file oppositions to omnibus motions to seal. Ripple CEO Brad Garlinghouse recently stated that the lawsuit might see a resolution in the first half of 2023.
